Terms & Conditions

These terms apply to everyone who uses HoofTrail, wherever in the world you're located.
1. Who we are
HoofTrail is owned and operated by Lucas IT Services, Ireland ("we", "us", "our"). By creating an account or using this site, you agree to these Terms & Conditions and to our Privacy Policy.
2. Your account
You must provide a valid email address to sign in. You're responsible for keeping access to your email secure, since our login system sends one-time codes there and anyone with access to your inbox can access your account. You must provide accurate information when creating your account and keep it up to date. You're responsible for all activity that happens under your account.
3. Content you post
You keep ownership of the photos, videos, and text you post. By posting, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content on the platform so other users can view it, in line with the visibility settings you choose. This licence ends when you delete the content or your account, except where a copy is retained for a short period in backups or as required by law. You're responsible for making sure you have the right to post whatever you upload, and for not posting anything illegal, harassing, defamatory, or infringing on someone else's rights (including copyright, trademark, privacy, or publicity rights).
4. Horse profiles, ownership transfer & marketplace activity
Horse profiles are created and managed by the user who added them. Ownership can be transferred to another user through the in-app transfer feature, which requires email confirmation from both the current and new owner before it takes effect. If you use HoofTrail to arrange, discuss, or agree a sale or purchase involving a horse, that transaction is solely between you and the other user. HoofTrail is not a party to it, is not a broker, escrow agent, or payment processor for it, and does not verify the accuracy of any listing, the condition, health, or value of any horse, or the identity or trustworthiness of any user beyond their emailed login. We do not guarantee, arrange, insure, or take responsibility for any payment, delivery, or outcome of a transaction agreed between users — the platform only records the change of profile ownership once both sides confirm it in-app. Conduct your own due diligence before agreeing to any sale, purchase, or transfer.
5. Contacting us
The /contact page is provided so you can reach our team with questions, feedback, or other enquiries. Submitting a message does not create any binding commitment on either side.
6. Acceptable use
When using HoofTrail, don't:
- Harass, threaten, or bully other users;
- Post spam, or content that's illegal, fraudulent, or misleading;
- Impersonate another person, business, or horse, or misrepresent your affiliation with anyone;
- Post content depicting animal cruelty or neglect;
- Attempt to access accounts, data, or areas of the platform that aren't yours or that you're not authorised to access;
- Interfere with the platform's normal operation, including through scraping, automated bulk access, or attempts to bypass rate limits or security controls;
- Use the platform to violate any applicable law.
We may remove content or suspend or terminate accounts that breach these terms — see Section 11.
7. Age requirements
You must meet the minimum age to consent to online services where you live — 16 in the EU/EEA unless your country sets a lower age (as low as 13), and 13 in the United States and most other countries. Regardless of local law, you must be at least 13 years old to use HoofTrail; we do not knowingly allow anyone younger to create an account. If you're old enough to sign up but younger than the age of majority in your country, you confirm you have a parent or guardian's permission to use HoofTrail, including any horse ownership transfer or marketplace activity described in Section 4.
8. Our intellectual property
The HoofTrail name, logo, and the platform's software, design, and branding are owned by Lucas IT Services or its licensors and are protected by copyright, trademark, and other laws. Using the platform doesn't give you any ownership or licence to use our branding, except as needed to use the service normally (for example, sharing a link to your profile).
9. Copyright infringement notices
If you believe content on HoofTrail infringes your copyright, contact us via /contact with: a description of the copyrighted work, the specific URL or location of the allegedly infringing content, your contact details, and a statement that you have a good-faith belief the use is unauthorised. We'll review and, where appropriate, remove or disable access to the content. Repeat infringers may have their accounts terminated.
10. Service availability
We aim to keep the service running reliably but don't guarantee uninterrupted, error-free, or continuous access. Features may change, be added, or be removed as the platform develops. We may introduce new features, including advertising on horse profiles that reach celebrity status, at our discretion.
11. Suspension & termination
You can delete your account at any time from your profile settings (you'll need to delete or transfer any horse profiles you own first). We may suspend or terminate your account, with or without notice, if we reasonably believe you've breached these terms, engaged in fraudulent or illegal activity, or created risk or legal exposure for us or other users. On termination, your right to use the platform ends immediately; Section 3's content licence and any accrued rights or obligations survive as described in this document.
12. Disclaimers & limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent permitted by law. We don't warrant that the platform will be uninterrupted, secure, or error-free, or that any content is accurate or reliable. To the extent permitted by law, Lucas IT Services is not liable for indirect, incidental, or consequential losses arising from your use of the platform, or from any transaction, dispute, or interaction between users (including under Section 4). Nothing in these terms limits liability that can't be excluded under the law of your country, including under EU consumer protection law or US state consumer protection statutes.
13. Indemnification
You agree to indemnify and hold Lucas IT Services harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your content, your breach of these terms, or your violation of any law or third party's rights — except where the claim arises from our own breach of these terms or applicable law.
14. Governing law & disputes
These terms are governed by the laws of Ireland, without prejudice to any mandatory consumer-protection rights you have under the law of the country where you live — including EU, UK, US state, or other local consumer laws that can't be contracted away. If a dispute arises, please contact us first via /contact so we can try to resolve it informally. EU residents can also use the European Commission's Online Dispute Resolution platform for out-of-court disputes.
15. Severability
If any part of these terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be read to reflect its intent as closely as the law allows.
16. Changes to these terms
We may update these terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the platform after changes means you accept the updated terms.
